General

 

Please read these Terms and Conditions and our Privacy Policy before placing an order with us as they form part of the contract between us. 

You should save or print a copy of the Terms and Conditions and Privacy Policy at the time you place your order. 

We reserve the right to make changes at any time to the online store, including the Terms and Conditions and Privacy Policy.  You will be subject to the Terms and Conditions and Privacy Policy that apply at the time you place your order except that any subsequent changes that are required as a matter of Law could apply to an order that you have already placed.

 

 


 

 

Definitions

 

Use of the term 'you' is to be taken as meaning you acting in an individual personal capacity as a customer; use of the term 'we', 'us', 'our' or 'attica' is to be taken as meaning the business trading in the United Kingdom under the name of attica located at: Unit 10e, Top Land Country Business Park, Cragg Vale, Hebden Bridge, West Yorkshire, HX7 5RW.

 

 


 

 

Trade buyers

 

Trade buyers or persons acting on behalf of a business must not place an order via the online store.  If you are acting in this capacity you are welcome to contact our sales staff by email, phone or fax to discuss your requirements.

 

 


 

 

Age restriction

 

You must not place an order or provide us with any personal information about yourself or provide us with your payment details unless you are aged 18 years or over.

 

 


 

 

Language

 

All communications relating to the placement of orders and the forming of any contract that exists between us for the delivery of goods must be undertaken in the English Language.

 

 


 

 

Legal jurisdiction and statutory rights

 

These Terms and Conditions do not affect any of your statutory rights.  Our online trading processes comply fully with the Distance Selling Regulations (2000), as amended (2005).  Any contract that exists between us should be construed as governed by the Law of England and Wales as may be determined by the jurisdiction of the English Courts.

 

 


 

 

 

Placing an order

 

Before placing your order, you can take as long as you like to browse the products available in our store and 'click' on the links provided, as required, to help inform your choice of product.  Please note that we cannot guarantee that your computer browser and monitor will exactly reproduce the full colour range of our yarn products. 

To purchase any of the items in our online store, simply click the 'Add to shopping basket' button shown on each product page.  You can return to the shopping basket at any time to check the contents, change the quantity of items you intend to buy and remove any unwanted items as desired.  

When you are happy that you wish to place an order to purchase the product or products in your 'Shopping basket', click the 'Check out' button.  We will ask you for the payment details, delivery address and your email address which we need from you in order to process your order and we will send you an email confirming receipt of your order and containing the details of your order. 

You are responsible for correctly providing your email address and we cannot accept liability for you not receiving our email if you have provided us with an incorrect email address. 

In providing us with your email address you agree that we may communicate with you by email and that communications by email satisfy any legal requirement for communications to be in writing. 

Your order represents an offer to us to purchase a product.  When you receive confirmation of an order from us this does not mean that we have accepted your order or that we have undertaken to deliver the order to you. 

All items offered on our website are subject to availability.  If an item you have ordered is no longer available, we will contact you by email. 

We will indicate acceptance of your order by sending you an email to confirm that your order has been processed and despatched to you.  We advise you to keep a copy of what you have ordered together with our order confirmation email.  From this point in time a contract exists between us and we agree to deliver your order.  Our order confirmation email together with our Terms and Conditions and Privacy Policy form the basis of the contract.  The contract will be filed by us in electronic form and will be made available to you on request.  

We reserve the right to refuse an order if we are advised by our secure payment provider that a transaction may be fraudulent or illegal in any other way. 

We will not be able to proceed with your order if the credit or debit account you have used for your online transaction with us has insufficient funds to meet the full cost of the order including any delivery charge. 

We reserve the right to cancel an order at our discretion.  If we cancel your order it will be without any charge to you and any monies already paid by you in respect of the cancelled order will be reimbursed in full as soon as possible and at the latest within 30 days of the cancellation. 

For safety reasons your order’s data are not accessible via the internet.  We keep these data in confidence according to our Privacy Policy.  Please refer to the 'Privacy Policy' section of our online store.

We currently accept orders from, and arrange delivery to, the following countries or Regions: United Kingdom and European Union.  Unfortunately we no longer accept orders from Non-European countries of the European Union or the Rest of the World. 

 

 


 

 

 

Currency and tax

 

All prices are in United Kingdom (UK) Pounds (£) Sterling and include UK Value Added Tax (VAT) at the appropriate rate.  Some of our products such as books are presently zero rated for VAT and no VAT will be included in the price we display for these items.  

Our VAT Registration Number is: 828 2695 94  

If you are shopping from outside the UK, please place your order in just the same way as described above and your payment card company will convert the transaction to your own currency.  This will be shown on your next card statement.  Please note that your card provider may charge an administration fee which is your, not our, liability to pay.

 

 


 

Prices

 

We take care to ensure that the prices we display in our online store are correct.  If we discover an error in the price displayed for a product that you have ordered we will inform you as soon as possible and you will have the option of reconfirming your order at the amended price or cancelling the order at no cost to you.  If we are unable to contact you in this situation we may cancel your order for the incorrectly priced item. 

Prices displayed in our online store apply to orders made online and are not necessarily the same as the price of identical products ordered from us by other means.  We reserve the right to alter our prices from time to time. 

Delivery charges are not included in the prices quoted.  When you reach the 'Check out' area of the online store you will be asked to pay an additional charge for delivery.  The delivery charge includes the cost of postage and packaging and a handling charge for processing your order.  

The delivery charge will depend on the total value of your order and on the country to which your order is to be shipped.

Payment

 

We accept payment by most major credit and debit cards.  Card payment is made by providing your card details online in the 'Check out' area of the store.  

You have the option of paying by Realex Secure ePayments or by PayPal.  Realex Secure ePayments is a secure payment provider service that ensures that your card details are encrypted when sent over the internet so that they are not visible in clear text to any other party operating on the internet.  Attica will not see or hold any record of your card details.  To pay by Realex Secure ePayments, select the 'Realex' option under 'Payment method' on the shopping basket page.  

Alternately you can pay by PayPal.  PayPal is a safe, fast and secure way to pay online.  Your financial details are never shared with us by PayPal, safeguarding your bank, credit or debit card details.  You do not need a PayPal account to pay by PayPal, all you need is your email address.  To pay by PayPal, select the 'PayPal' option under 'Payment method' on the shopping basket page.  When you pay by PayPal the transfer of funds from your account to our account takes place immediately.  If we are unable to meet your order for any reason, in part or in full, we will use PayPal to refund any monies owing to you without delay.  PayPal undertake to protect your purchases so just in case there's a problem you can get your money back (PayPal Terms and Conditions apply).

Please note that we will never ask you to provide any card details via email.  If you do receive an email claiming to be from us requesting your card details, please inform us immediately and do not reply to the email. 

 

 


 

 

Delivery

 

We aim to process and despatch your order within 1 to 2 working days for products that we currently have in stock.  

For products that we do not have in stock we will inform you by email within 1 to 2 working days of an estimated delivery date so that you can decide if you wish us to proceed with processing your order.  

Once we have accepted your order, goods will be delivered within 30 days unless we agree a later delivery date which is acceptable to you.  If goods fail to arrive within 30 days you are entitled to cancel the order and receive a full refund of all the money paid by you for the cancelled goods.

UK orders are sent by Royal Mail First Class Post.  Larger value orders may be sent by Royal Mail First Class Signed for (a signature will be required).  We cannot guarantee delivery times but Royal Mail aims to deliver 94% of First Class Post by the next working day including Saturday.

Orders for European Union countries will be sent by small packet Airmail (up to 2 kg) via Royal Mail.  Orders in excess of 2 kg will be sent in more than one packet, each weighing less than 2 kg.  We cannot guarantee delivery times but Royal Mail aims to deliver Airmail to EU countries in 3 working days. 

EU Member States are currently: Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and the United Kingdom. 

Unfortunately we no longer accept orders for Non-European countries of the European Union or the Rest of the World.

 


 

 

Customs and Excise

 

None of our products are subject to export restrictions or liable for excise tax.  In addition to the total price you pay to us, you may also have to pay a local customs duty or import tax.  We do not accept liability should local customs authorities confiscate any particular delivery item or charge any import duty.  You, the recipient of the order, are responsible for paying any import duty imposed.  Royal Mail may charge you for processing your package through customs.  These charges are normally collected together with any duty/taxes on delivery but they are not customs duties.  If you need to know the exact cost of these extra charges in advance, you should contact Royal Mail and ask what their charges will be.

 

 


 

 

Ownership

 

Ownership of a product or products will only pass to you when we have received full payment of all sums due in respect of the product(s) including delivery charges.

 

 


 

 

 

Cancellation after delivery

 

You have the right to cancel your order and to receive a full refund if you notify us within seven working days (starting the day after you receive the goods).  This is to allow you time to see the goods at first hand and to decide if you want to keep them.  It is not dependant on the goods being defective in any way. 

If you decide to cancel your order we will then refund, within 30 days, all money paid by you for the goods.  Refunds will be made direct to your credit or debit card account, not in any other way. 

It is your responsibility to give notice in writing, by email, fax or letter, of your wish to cancel within this cancellation period.  We will provide you with confirmation that we have received your notification of cancellation of your order and we will provide you with a 'Return Number'. 

You are under a duty to take reasonable care of the goods for return.  You will be liable for the cost of any loss or damage in respect of goods for return. 

The goods must be returned in an unused and re-saleable condition, in the case of yarn with unmarked and undamaged labels and free from physical damage or noxious odour.  

The cost of returning goods cancelled after despatch will be borne by you, not by us.  We cannot accept liability for returned goods lost or damaged in transit so you are advised to package the product carefully to avoid damage and we would recommend for your own protection that you use a recorded delivery or courier service.  

You must include your name and address and the 'Return Number' when you return goods to us for any reason.  

If you do not dispatch the goods back to us within 7 working days following the day you received them then you should make the goods available for collection by a courier service nominated by us and you will have to reimburse us for the full direct costs we incur in arranging collection by the courier. 

When you place an order, details of your cancellation right will be sent to you with your confirmatory email.  

 

 


 

 

 

Guarantees

 

We guarantee to supply goods of satisfactory quality and fit for purpose.  If the goods you receive from us are defective, you should inform us without undue delay by email, letter, fax or phone, describing the fault with the product that you have identified, and we undertake to provide replacement of the defective product, subject to availability, at no additional cost to you.  Alternatively, if you prefer, we will provide you with a full refund equal to the cost of the faulty goods. Orders placed by credit or debit card will be refunded directly to your credit or debit card. 

We may ask you to return defective goods in which case we will provide full reimbursement for the direct cost incurred by you for postage and packaging.  

 

 


 

 

 

Use of website and intellectual property

 

Access to our online store website is provided free of charge.  We cannot guarantee that you will always be able to access the website and we reserve the right to alter the content of the website at any time and at our sole discretion.  We do not guarantee that the information it contains is accurate and up-to-date but we will strive to ensure that the content is as accurate and as up-to-date as possible. 

When you access our website you may incur telecommunication costs in connecting to the internet.  You, not us, are responsible for any costs incurred in accessing our website over the internet.

We do not accept any liability to compensate you for any inconvenience or financial loss that you may incur as a result of our website being unavailable at any time for any reason or for any errors or omissions in the content of our website.

The content of the website, including all text, images, icons, logos, graphics and photographs belongs to us or to our suppliers.  By accessing and using our website you do not have permission to take ownership of the content or to replicate, alter or otherwise use in any way the content of our website for  commercial use.  The website is provided exclusively for your personal use for the purposes of viewing the content of our online store, placing a purchase order or communicating with us in connection with your order, to offer your comments and suggestions or to make a complaint.

Our website includes links to other websites.  These links are provided for your convenience.  We do not control these linked websites and do not take responsibility for their availability or content.  If you access any website to which we link, then you do so at your own risk and you are advised to check the privacy statement and terms and conditions of the website you have linked to.

If you are using a public or shared computer or terminal you should log out of our website and close the computer's internet browser before leaving the computer or terminal.  This is to ensure security of your personal information including payment details.

If you have signed in as a regular user of our website, you should keep your password private because anybody who knows your password may be able to access your account with us.

When you create a password you should make it at least 8 characters long and include at least one number or symbol.  Do not use your name, email address or other personal information that could be easily guessed by somebody wanting to access your account without your knowledge or authority.

Your contributions are important to us in helping to maintain and develop our product range and purchasing facility.
